Terms of Service
By clicking “I Accept,” or by downloading, installing, accessing, or using this site in any way, you confirm that you have read, understood, and agree to be bound by the following terms and conditions, including VetRelief.pet's Privacy Policy (collectively referred to as the “Terms”). If you are not eligible or do not agree to these Terms, you do not have permission to use the site. Your use of the site, along with VetRelief.pet’s provision of the site to you, constitutes an agreement between VetRelief.pet and you to adhere to these Terms.
VetRelief.pet operates the website at www.VetRelief.pet, along with related websites and mobile applications linked to these Terms of Use (collectively, the “Site”). We provide online services related to pet health (the “Services”), including those using digital interactive audio and video technology such as text messaging, online chat, and digital video conferencing. These services enable our users (“Users”) to report their pets’ health history and engage with veterinary professionals (“Providers”) to obtain veterinary services.
Veterinary Medicine Services
If you are agreeing to these Terms as a veterinarian, you confirm that you hold a current and valid license to practice veterinary medicine in your country of residence and that you are in good standing in all jurisdictions where you will provide services through the Site. You acknowledge that you are solely responsible for the services you provide to Users and their pets.
VetRelief.pet does not practice veterinary medicine, pharmaceutical services, or any other licensed profession. We do not interfere with the practice of veterinary medicine, pharmaceutical services, or any other licensed profession provided by Providers. Each Provider is responsible for their services and for complying with the legal requirements applicable to their profession and license.
Neither VetRelief.pet nor any third parties who promote the Services or provide Users with a link to the Site shall be liable for any professional advice Users or their pets obtain from a Provider via the Services. When a Veterinary-Client-Patient Relationship (VCPR) is established through audio-visual means rather than an in-person physical exam, the VetRelief.pet platform does not allow the prescribing of Schedule I through V drugs as listed by the United States Drug Enforcement Administration.
Administration
You agree to follow all applicable laws and regulations, including maintaining a valid, unexpired license to practice veterinary medicine, and remain in good standing in every state where you practice. This includes adhering to all statutes and regulations within your state’s veterinary medicine practice act (collectively, the “Applicable Veterinary Laws”).
You also agree to comply with all relevant statutes, regulations, professional rules, and guidelines regarding data and privacy, as well as the specific license requirements related to the practice of veterinary medicine. If you are licensed in the United States, this includes following the Principles of Veterinary Medical Ethics of the American Veterinary Medical Association.
Additionally, you agree not to post any content that is obscene, defamatory, false, unlawful, or that infringes upon the rights of others, including intellectual property rights. You also agree not to post content that could be considered advertising or solicitation unless explicitly authorized by VetRelief.pet.
Provider Responsibilities and Data Privacy
Providers using the Services are solely responsible for understanding the limitations and restrictions associated with teletriage, telehealth, telemedicine, and online care based on the jurisdiction in which they are licensed. VetRelief.pet is not responsible for interpreting local legislation or providing guidance on how Providers should use the Services. Providers must fully understand what their licenses permit. VetRelief.pet is not liable for any errors Providers make in following the permissions set by their licensing bodies.
You must not disclose personal information about another user to any third party without the user’s consent. Additionally, you agree to protect other users' personal information with the same level of care that you use to protect your own confidential information, using at least a reasonable standard of care. You assume all liability for the misuse, loss, or unauthorized transfer of such information.
Veterinary Services and VCPR Requirements
As a Provider, you may only diagnose, treat, or prescribe medication for a User’s pet if you have established a valid Veterinarian-Client-Patient Relationship (VCPR) in accordance with applicable law for the specific pet. The requirements for a valid VCPR can vary by jurisdiction. The VCPR for the pet must have been established within a reasonable time frame relative to the pet’s specific condition, but no more than one year before you provide VCPR Services to the User on the Site. If a valid VCPR has not been established, you agree not to provide any services that require a VCPR.
A veterinary practitioner should only prescribe, dispense, or administer a prescription in good faith for medicinal or therapeutic purposes within the scope of their professional practice.
Data Privacy and Information Disclosure
Although VetRelief.pet is not a party to any transaction and assumes no liability for legal or regulatory compliance related to veterinary services listed on the Site, there may be circumstances where we are legally obligated to provide information about a Provider's notes, advice, or records to governmental bodies for investigations, litigation, or administrative proceedings. VetRelief.pet may choose to comply with such obligations at its sole discretion.
Text Messages
VetRelief.pet and our representatives may send you text (SMS) messages at the phone number you provide. These messages may include important operational information about your use of the Site. You can opt out of receiving operational text messages at any time by sending an email to support@vetrelief.pet with your request and the phone number of the device receiving the texts. You may continue to receive text messages for a short period while we process your request, and you may also receive text messages confirming your opt-out request. Please note that opting out of operational text messages may affect the functionality of the Site for you. Text messages may be sent using an automatic telephone dialing system. Agreeing to receive text messages is not a condition for any purchase or use of the Site. Standard data and message rates from your carrier may apply whenever you send or receive messages.
Emails
We may send you emails about our products and services, as well as those of third parties. To opt out of promotional emails, follow the unsubscribe instructions or email us at support@vetrelief.pet.
Online Pharmacy
VetRelief.pet’s Online Pharmacy is provided by a third-party, Strategic Pharmaceutical Solutions, Inc., doing business as Vetsource (“Vetsource”). All applicable Vetsource terms and conditions, including Vetsource’s Shipping Rates and Policies, apply. Prescriptions are shipped by Vetsource based on the shipping option you select when placing your order with Vetsource. Users must contact Vetsource directly for any issues related to refunds for prescriptions purchased through their site.
Communication Confidentiality and Recording
Communications conducted electronically (including audio and video) or via phone through the Site are not confidential or privileged and will not be treated as such. You understand and agree that all such communications may be recorded for training and quality control purposes.
You grant VetRelief.pet the right to record video and audio calls made using the Site or Services (“Recordings”). Users can upload various content types to the Service, including messages, reviews, photos, videos, and more (collectively “User Content”), and publish it. You retain all copyright and other proprietary rights to your User Content. VetRelief.pet will not distribute your User Content in any media formats and through any channels outside of the site.
Account Information and Access Rights
When you register on the Site, you need to create an account (“Account”) by providing your name, email address, password, and other information collected by VetRelief.pet (collectively referred to as “Account Information”). You agree that the Account Information you provide, including during registration and any updates on the Site, will be truthful, accurate, current, and complete. It’s your responsibility to regularly review and update your Account Information to maintain its accuracy.
You are granted limited, non-transferable rights by VetRelief.pet to access the Site and use the Services, strictly in accordance with these Terms of Use and any additional agreements you have with us (“Access Rights”). We reserve the right, at our discretion, to deny or suspend access to the Site or Services for any reason.
You agree:
Not to impersonate any person or entity or misrepresent your affiliation.
Not to use the Site or Services for activities that violate local, state, national, or international laws.
Not to attempt to reverse engineer, disassemble, decompile, or translate any part of the Site or Services.
Not to distribute viruses or other harmful computer code through the Site.
Not to exceed the scope of use permitted.
To refrain from using abusive language in communications with Users through the Site.
To conduct all telehealth services with Users exclusively through the Site.
Payment Terms
As a Provider on VetRelief.pet, you have the authority to set and adjust the pricing terms for the Services you offer. Users receiving your Services through the Site will be charged according to your fee schedule, which you authorize us to collect on your behalf. Payments will be electronically transferred to your account via the Stripe Connect payment processor, following the bank payment instructions you provided through Stripe.
Moreover, you may request alternative payment methods such as checks, ACH payments, or Zelle. We will continue to use the payment instructions you initially provided until updated instructions are given. It is essential to refrain from contacting Users outside the Site to negotiate different payment terms for your Services.
If a Veterinarian or Hospital opts for VetRelief.pet to handle payments directly by skipping the Stripe Connect enrollment process, the veterinarian and/or hospital must agree on VetRelief.pet’s payment terms and schedules. This ensures clarity and mutual understanding regarding financial transactions related to the Services provided.
Ownership and Confidentiality
The Site and all its contents, features, and functions—including information, software, text, displays, images, video, audio, and their arrangement—are owned by VetRelief.pet, its licensors, or other providers, and are protected by US, Canadian, and international laws governing copyright, trademark, patent, trade secret, and other intellectual property rights. These Terms of Use allow you to use the Site solely for the purposes explicitly stated herein.
You are not permitted to reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from the Site, except as permitted through the Site under these Terms of Use. Use of any part of the Site or its services or materials for commercial purposes is prohibited, except as expressly permitted herein.
Additionally, any photographs, videos, images, or other information provided by Users for whom you provide services are confidential and must be kept private and not republished for any purpose. Any information you maintain as a result of interactions with Users on the Site must comply with the statutes and regulations governing the maintenance of medical records as outlined in the Applicable Veterinary Laws.
Termination
You have the option to deactivate your Account and unregister at any time by contacting support@VetRelief.pet. VetRelief.pet retains the right to suspend or terminate your access to the Site, Account, or registration without prior notice and for any reason.
According to our internal policies and as allowed by law, VetRelief.pet may preserve, delete, or discard all communications and materials posted or uploaded to the Site. Upon termination, VetRelief.pet is no longer obligated to provide Services.
Disclaimer of Warranties; Release
Your use of the Site or Services is solely at your own risk. Both the Site and Services are provided on an “as is” and “as available” basis. VetRelief.pet explicitly disclaims all warranties, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, title, operability, condition, accuracy of data, system integration, reliability of performance, and freedom from errors, viruses, or other harmful components. You are entirely responsible for your use of this Site and any services related to it.
You acknowledge that VetRelief.pet functions solely as a technology platform to connect pet owners with independent third-party Providers, and does not provide veterinary medicine advice, diagnosis, or treatment. Regarding limitation of liability, to the extent permitted by applicable law, VetRelief.pet, its shareholders, officers, employees, managers, directors should not be responsible for damages or loss of revenues, profits, goodwill, use, data, or other intangible losses, whether based on contract, warranty, statute, or otherwise.
Indemnification
You agree to indemnify, defend, and hold harmless VetRelief.pet, its shareholders, officers, directors, managers, employees, agents from any claims, actions, demands, liabilities, and settlements.
By agreeing to these terms, you acknowledge that both you and VetRelief.pet are waiving the right to a jury trial or participation in a class action.
Insurance Requirement
As a Provider, you must maintain veterinary malpractice insurance throughout your tenure, with coverage commensurate to the scope of your veterinary practice or as required by applicable veterinary laws.
When you agree to these Terms of Use by checking the “agree” box or consenting to any other forms on the Site, you are providing a legally binding signature. By doing so, you acknowledge that we may send you privacy notices, disclosures, or other communications regarding the Services ("Communications") electronically. This includes sending Communications to the email address you provided during registration or posting them on the Site. The delivery of these Communications is considered effective upon our sending them, regardless of whether you read them immediately upon receipt. You have the option to withdraw your consent to receive Communications and unsubscribe at any time. This can be done by contacting us via email at support@vetrelief.pet.
VetRelief.pet does not waive any terms or conditions in these Terms of Use by failing to enforce them, and such failure does not prevent VetRelief.pet from enforcing those terms later. If any provision of these Terms of Use is found invalid or unenforceable, it will be limited or removed to the minimum extent necessary while the remaining terms remain in effect.
VetRelief.pet is not liable for the internet or data signal of your mobile device.

VetRelief.pet (“VetRelief.pet”, “we”, “us”, or “our”) provides pet parents (“Users”) with online services related to their pets' health using digital interactive audio and video technology (including but not limited to digital video conferencing) enabling Users to report the health history of their pets and engage with third party veterinary professionals or our team of veterinary professionals (collectively, the “Services”). The Services are accessed and provided through our web and mobile applications (“App(s)”) and supporting information and account customer service is available on our website located at www.VetRelief.pet and may be available through other related websites with links to these Terms of Service (collectively, the “Services”). Only residents of the United States (excluding the province of Quebec) are eligible to access and use the Services.
By registering for and/or accessing and using the Services, you agree to be bound by these Pet Parent Terms of Service (“Terms of Service”) and all other terms and policies that appear on the Services. you must meet the age requirement specified by your jurisdiction to access or use the services provided by VetRelief.pet. By accepting the terms of service (by clicking "I ACCEPT" or by accessing the services in any manner), you are agreeing to be legally bound by these terms and conditions. If you do not agree to all of these terms, you should refrain from using the services. Using VetRelief.pet's services signifies your agreement to these terms, forming a legally binding contract between you and VetRelief.pet.
Abritration Notice
You agree that disputes arising under these Terms will be resolved by binding, individual arbitration, and BY ACCEPTING THESE TERMS, YOU AND VETRELIEF.PET ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING. YOU AGREE TO GIVE UP YOUR RIGHT TO GO TO COURT to assert or defend your rights under this contract (except for matters that may be taken to small claims court). Your rights will be determined by a NEUTRAL ARBITRATOR and NOT a judge or jury.
Scope of Service
Only residents of the United States are eligible to access the Services. Support provided via our website is only for non-medical or non-veterinary services support, not for making use requests for the Services. At this time, Services are available on a pay-per-call model.
To access site features, create an account with a user ID and password. Keep your account info accurate and update contact details promptly. Personal information is managed as per our Privacy Policy.
Your access to and use of the Site are strictly personal and cannot be transferred to anyone else. You are responsible for keeping your user ID and password confidential and for all activities that occur under your Account. Using another user's Account without permission is prohibited. Notify VetRelief.pet immediately of any unauthorized use or security breach of your user ID or password. If unauthorized access is suspected, you agree to promptly change your user ID and password upon request and take any necessary actions as advised by us.
VetRelief.pet cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements. Each user acknowledges and agrees that: (a) VetRelief.pet will not have any liability to any user for any unauthorized transaction made using your user ID or password; and (b) the unauthorized use of your user ID and password for your Account could cause you to incur liability to both VetRelief.pet and other users.
Verifying users online is challenging, and we do not verify each user's identity. We suggest using the site's communication tools, but even these may not confirm a user's identity. It's advisable to take additional reasonable steps to verify someone's identity.
VetRelief.pet and those acting on our behalf may send you text (SMS) messages at the phone number you provide us. These messages may include operational messages about your use of the Services. Text messages may be sent using an automatic telephone dialing system. Standard data and message rates may apply whenever you send or receive such messages, as specified by your carrier.
Telehealth & Telemedicine Veterinary Medicine Services
Telehealth and/or Telemedicine Veterinary Medical Services may be provided on a pay-per-call basis. The independent veterinary professionals (“Providers”) who deliver Telehealth and/or Veterinary Medical Services through VetRelief.pet are independent professionals solely responsible for the services each provides to you and your pets. VetRelief.pet does not, as part of offering Veterinary Medical Services, practice veterinary medicine, pharmaceutical services, or any other licensed profession, and does not interfere with the practice of veterinary medicine, pharmaceutical services, or any other licensed profession by Providers, each of whom is responsible for his or her services and compliance with the requirements applicable to his or her profession and license. Neither VetRelief.pet nor any third parties who promote the Services or provide you with a link to the Services shall be liable for any damages allegedly caused by the professional advice you or your pet obtains from a Provider via the Services.
In order for a Provider to diagnose, treat, or prescribe medication to you or your pet (the “VCPR Services”), you must have established a valid Veterinarian-Client-Patient Relationship (“VCPR”) with that Provider under applicable law for the specific pet that is the subject of the Services. The requirements of a valid VCPR may vary jurisdiction to jurisdiction. The VCPR for the specific pet that is the subject of the VCPR Services must have been established within a reasonable time considering the specific condition of the pet but in no case more than a year prior to the provision of services. If you intend to use VCPR Services, you represent that a VCPR exists with the Provider and pet you have connected or, in the absence of a VCPR, you are only seeking veterinary advice and not a diagnosis, treatment, or prescription medication. A practitioner of veterinary medicine shall only prescribe, dispense, or administer a prescription in good faith for medicinal or therapeutic purposes within the course of his or her professional practice.
Providers may also at their discretion and where allowed by law, prescribe any medication they deem to be medically appropriate based on the pet’s medical needs. When a VCPR is formed by audio-visual means rather than an in-person physical exam, VetRelief.pet does not allow the prescribing of Schedule I through V drugs as listed by the United States Drug Enforcement Administration.
VetRelief.pet’s Online Pharmacy is provided by a third-party Strategic Pharmaceutical Solutions. Inc, doing business as Vetsource (“Vetsource”) and is subject to all applicable Vetsource terms and conditions, including, but not limited to, Vetsource’s Shipping Rates and Policies. Prescriptions are shipped by Vetsource based on the shipping option selected by you when you place your order with Vetsource. Users must deal directly with Vetsource, regarding refunds relating to prescriptions purchased through their site.
Service of Content
None of the Services content (other than information you receive from a Provider) should be considered medical advice or an endorsement, representation or warranty that any particular medication or treatment is safe, appropriate, or effective for your pet.
Informed Consent
YOU CONSENT TO THE EXCHANGE AND RELEASE OF INFORMATION AND RECORDS (INCLUDING COMMUNICATIONS RECORDED IN CONNECTION WITH THE SERVICES) RELATED TO YOUR PET BETWEEN AND FROM YOUR REGULAR VETERINARIAN (OR OTHER VETERINARY CLINIC THAT HOLDS SUCH RECORDS), VetRelief.pet, AND YOUR PROVIDER. VetRelief.pet MAY STORE YOUR PET'S MEDICAL RECORDS IN VetRelief.pet's SYSTEM SO THAT PROPER CARE MAY BE GIVEN.
Our Services involve the delivery of veterinary medical services using interactive audio and video technology, where the User and the applicable pet are not in the same physical location as the veterinary professional. During your consultation with a Provider, details of your pet's health history and health status information may be discussed with you through the use of interactive video, audio and other telecommunications technology, and your Provider may ask for your assistance to conduct an assessment of your pet through these technologies. In addition, each User hereby grants VetRelief.pet the right to record video and audio calls made when a User is using the Services (“Recordings”). Each User acknowledges and agrees that these Recordings may capture certain items that are considered to be biometric identifiers such as your face and voice. Such biometric identifiers are not used to identify you but are only used to provide the Services to you in accordance with these Terms. You expressly consent to our capture and use of biometric identifiers in the Recordings in accordance with these Terms.
Electronic (including audio and video) or phone communications via the Services are not confidential or privileged and will not be the subject of any associated confidences or privileges. You understand and agree that all such communications may be recorded for training and quality control purposes and for review by the VetRelief.pet team. VetRelief.pet reserves the right to determine how long to store the communications and/or recordings. Requests for recordings will be evaluated on a case-by-case basis.
The video telehealth and/or telemedicine services you receive from Providers are not intended to replace a primary care veterinary relationship or be your permanent veterinary medical service but rather augment these services. You should seek emergency help or follow-up care: when recommended by a Provider; if the pet appears in pain; if there appears to be a risk of injury to human or animal; or when otherwise needed; and continue to consult with your primary veterinarian and other veterinary professionals as recommended. You may make arrangements for follow-up care either through VetRelief.pet or other veterinary providers. Among the benefits of our Services are improved access to veterinary medicine professionals and convenience. However, as with any veterinary medicine service, there are potential risks associated with the use of telehealth and/or telemedicine services. These risks include, without limitation, the possibility that information transmitted may not be sufficient (e.g., poor resolution of images) to allow for appropriate care decision-making by the Provider. In addition, delays in evaluation or treatment could occur due to failures of the electronic equipment or telecommunications networks. If this happens, you may be contacted by phone or other means of communication. It is possible that a lack of access to all of your pet's health records or other relevant information (including without limitation historical, medical, and behavioral information) may result in adverse drug interactions or allergic reactions or other judgment errors.
By accepting these Terms, you acknowledge that you understand and agree with the following: You understand that no results can be guaranteed or assured, despite any anticipated benefits from the use of the Services. Your Provider, as applicable for the Services being provided, may determine that the Services are not appropriate for some or all of your pet's treatment needs, and accordingly may elect not to provide telehealth and/or telemedicine services for your pet through the Services.
IF YOUR PET IS EXPERIENCING A MEDICAL EMERGENCY, YOU SHOULD GO TO YOUR NEAREST VETERINARY TREATMENT CLINIC.
User Accounts
When you sign up for our Services, you need to create an account ("Account") by providing your name, email address, password, and other required details collected by VetRelief.pet ("Account Information"). You must be of legal age in your jurisdiction to create an Account. You agree that all Account Information you provide, including during registration and any uploaded content, is truthful, accurate, current, and complete. You must keep your Account password confidential and not share it with anyone or create multiple Accounts. You are responsible for all activities that occur under your Account. VetRelief.pet reserves the right to take necessary actions to ensure the security of the Services and your Account Information. VetRelief.pet is not liable for any damages resulting from your use of the Services or the release of your Account Information to others. You are prohibited from using anyone else's account.
Our Services are not meant for children, and children cannot use them. If we find out you are under the legal age in your area, we will take steps to remove your information from our systems. By using our Services, you confirm you are of legal age in your area
Licenses
We grant you a limited, non-transferable right to access and use the Services for your personal, non-commercial use, as allowed by these Terms of Service and any other agreements with us. We reserve the right to deny or suspend access to the Services at our discretion. You agree not to: (a) impersonate anyone or misrepresent your affiliation; (b) use the Services for illegal purposes; (c) attempt to reverse engineer or modify the Services; (d) distribute viruses or harmful code; or (e) use the Services beyond their intended scope. When communicating with Providers through the Services, please refrain from abusive language. VetRelief.pet does not endorse interactions with Providers outside the Services. For security, avoid using public computers and do not save your Account password in web browsers or other software.
Certain features of the Service allow Users to upload various types of content, such as messages, reviews, photos, videos, and text (collectively referred to as "User Content"). You may choose to publicly post certain User Content, like reviews, on VetRelief.pet. You retain ownership of any copyright and other rights you hold in the User Content you post. By providing User Content through the Service, you grant VetRelief.pet a worldwide, royalty-free license to host, store, display, modify (for formatting purposes), and share your User Content with Providers or other veterinarians you designate. This license also allows VetRelief.pet to distribute your User Content through any media channels now known or developed in the future. Additionally, for User Content you submit for posting, you grant VetRelief.pet the right to host, store, display, modify (for formatting purposes), and distribute your User Content. If a Provider or another User needs to access your User Content, you grant them a non-exclusive license to do so as allowed by these Terms and the Service's features. You waive any moral rights you may have regarding your User Content.
Fees and Purchase Terms
You agree to pay all fees or charges to your Account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable. Current fees and billing terms for the Services will be as described by VetRelief.pet prior to your use of the Services, and such fees and billing terms may be updated by VetRelief.pet from time to time in its sole discretion. By providing VetRelief.pet with your credit card number or other payment account and associated payment information, you agree that VetRelief.pet is authorized to immediately invoice your account for all fees and charges due and payable to VetRelief.pet hereunder and that no additional notice or consent is required. VetRelief.pet, at its sole discretion, may make promotional offers with different features and different pricing to any of VetRelief.pet's customers. These promotional offers, unless made to you, will not apply to your offer or these Terms.
You are entitled to a refund of your payment to VetRelief.pet if (i) VetRelief.pet encounters a technical issue which results in the inability of your Provider to complete a video consultation (this excludes device or internet connection issues on your end to access the video consultation or Service); or (ii) your Provider is unable to provide you with any information, guidance, or advice regarding your pet, as determined by VetRelief.pet in its reasonable discretion. (iii) if your Provider misses the appointment.
If you believe you are entitled to a refund, please contact the VetRelief.pet team as soon as possible by email to: support@VetRelief.pet. We will then verify whether you are entitled to a refund and, if appropriate, complete the refund as soon as possible.
All financial transactions will be processed in U.S. dollars. You acknowledge and agree that you shall be personally responsible for all incurred expenses. You may deactivate your Account and end your registration at any time, for any reason by sending an email to support@VetRelief.pet. VetRelief.pet may suspend or terminate your use of the Services, your Account and/or registration for any reason at any time. Subject to applicable law, VetRelief.pet reserves the right to maintain, delete or destroy all communications and materials posted or uploaded to the Services pursuant to its internal record retention and/or content destruction policies. After such termination, VetRelief.pet will have no further obligation to provide the Services.
Right To Modify
We may at our sole discretion change, add, or delete portions of these Terms of Service at any time on a going-forward basis. Continued use of the Services following notice of any such changes will indicate your acknowledgement of such changes and agreement to be bound by the revised Terms of Service, inclusive of such changes.
Disclaimer of Warranties; Release
YOU EXPRESSLY AGREE THAT USE OF THE SERVICES IS AT YOUR SOLE RISK. SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. YOU ASSUME TOTAL RESPONSIBILITY AND RISK FOR YOUR USE OF THE SERVICES.
You acknowledge and agree that VetRelief.pet does not provide veterinary medicine advice, pharmaceutical services, diagnosis, or treatment, and is strictly a technology platform and infrastructure for connecting pet owners with independent third-party Providers, including veterinarians and potentially other veterinary professionals in the VetRelief.pet network. You acknowledge and agree that the Providers using the Services are solely responsible for and will have complete authority, responsibility, supervision, and control over the provision of all veterinary medicine services, advice, instructions, treatment decisions, pharmaceutical services, and other veterinary health care services performed, and that all diagnoses, treatments, procedures, and other veterinary health care services will be provided and performed exclusively by or under the supervision of the Providers, in their sole discretion, as they deem appropriate.
Limitation of liability
YOU UNDERSTAND THAT TO THE EXTENT PERMITTED UNDER APPLICABLE LAW, IN NO EVENT WILL VetRelief.pet OR ITS SHAREHOLDERS, OFFICERS, EMPLOYEES, MANAGERS, DIRECTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF REVENUES, PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. VetRelief.pet'S TOTAL AGGREGATE LIABILITY FROM ANY AND ALL CLAIMS UNDER THESE TERMS IS LIMITED TO THE TOTAL AMOUNTS YOU PAID TO VetRelief.pet THAT WERE RETAINED BY VetRelief.pet (AFTER REMITTING AMOUNTS DUE TO PROVIDERS).
Indemnification
You agree to indemnify, defend and hold harmless VetRelief.pet, its shareholders, officers, directors, managers, employees, agents, suppliers, successors and assigns from and against any claim, actions, demands, liabilities and settlements, including without limitation reasonable legal and accounting fees (“Claims”), resulting from, or alleged to result from, your violation of these Terms of Service. In addition, you agree to indemnify, defend and hold harmless your Provider(s) from and against any third-party Claims resulting from your lack of adherence with the advice or recommendation(s) of such Provider.
VetRelief.pet reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims. You agree not to settle any matter without the prior written consent of VetRelief.pet. VetRelief.pet will use reasonable efforts to notify you of any such claim, action or proceeding upon becoming aware of it.
Geographical Restrictions
VetRelief.pet makes no representation that all products, services and/or material described on the Services, are appropriate or available for use in locations outside, or all territories in, the United States. The Service is not intended for distribution or use in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject VetRelief.pet to any registration requirement within such jurisdiction or country.
Disclosures
All veterinarians on the Service have represented that they are professionally licensed upon initially being permitted to use the Services. However, the Service does not validate or monitor the compliance by Providers with licensing requirements. It is important to verify the Providers license is valid. Professional licenses are issued by the professional veterinary licensing boards in the states where the Providers practice.
Dispute Resolution and Arbitration
YOU UNDERSTAND AND AGREE THAT, BY ENTERING INTO THESE TERMS, YOU AND VetRelief.pet ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.
Arbitratior
Any arbitration between you and VetRelief.pet will be settled under the Federal Arbitration Act and administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules (collectively, “AAA Rules”) as modified by these Terms. The AAA Rules and filing forms are available online at www.adr.org, by calling the AAA at 1-800-778-7879, or by contacting VetRelief.pet. The arbitrator has exclusive authority to resolve any dispute relating to the interpretation, applicability, or enforceability of this binding arbitration agreement. A party who intends to seek arbitration must first send a written notice of the dispute to the other party by certified U.S. Mail or by Federal Express (signature required) or, only if that other party has not provided a current physical address, then by electronic mail (“Notice of Arbitration”). VetRelief.pet's address for Notice is: VetRelief.pet, 24701 La Plaza #205 Dana Point, CA 92629. The Notice of Arbitration must: (a) describe the nature and basis of the claim or dispute; and (b) set forth the specific relief sought (“Demand”). The parties will make good faith efforts to resolve the claim directly, but if the parties do not reach an agreement to do so after the Notice of Arbitration is received, you or VetRelief.pet may commence an arbitration proceeding. All arbitration proceedings between the parties will be confidential unless otherwise agreed by the parties in writing. During the arbitration, the amount of any settlement offer made by you or VetRelief.pet must not be disclosed to the arbitrator until after the arbitrator makes a final decision and award, if any.
MISCELLANEOUS
You may not assign or transfer these Terms or your rights under these Terms, in whole or in part, by operation of law or otherwise, without our prior written consent. We may assign these Terms at any time without notice or consent. These Terms of Service and your use of the Services shall be governed by the laws of the State of California, without giving effect to the principles of conflict of laws. The parties agree to the personal and subject matter jurisdiction and venue of the courts located in Los Angeles, California, for any action related to these Terms of Service.
You understand that by checking the “agree” box for these Terms of Service and/or any other forms presented to you on the Services you are agreeing to these Terms of Service and that such action constitutes a legal signature. Subject to applicable law, you agree that we may send to you any privacy or other notices, disclosures, or communications regarding the Services (collectively, “Communications”) through electronic means including but not limited to: (1) by e-mail, using the address that you provided to us during registration, or (2) by posting the Communications on the Services. The delivery of any Communications from us is effective when sent by us, regardless of whether you read the Communication when you receive it or whether you actually receive the delivery. No waiver by VetRelief.pet of any term or condition set forth in these Terms of Service shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of VetRelief.pet to assert a right or provision under these Terms of Service shall not constitute a waiver of such right or provision. If any provision of these Terms of Service is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Service will continue in full force and effect.
